Rule updates

Changes to the rule, court cases, enforcement and funding, newest first, each with its source.

  1. OCR resolution with a Pennsylvania school district covers PDFs

The U.S. Department of Education's Office for Civil Rights reached a voluntary resolution with Council Rock School District (Docket 03-25-1460) requiring the district to audit and correct barriers across its websites, PDFs, videos, social media, third-party platforms and mass notification systems, under Section 504 and Title II. Complaints to OCR do not wait for the web rule's compliance dates.

  2. National Federation of the Blind sues to undo the extension

The NFB sued DOJ and HHS in the U.S. District Court for the District of Maryland under the Administrative Procedure Act, asking the court to vacate both deadline-extension rules. If the NFB wins, the original, earlier dates could come back.

  3. DOJ extends the compliance dates by one year

An interim final rule moved the dates in 28 CFR § 35.200(b). Entities with a total population of 50,000 or more now have until April 26, 2027 (was April 24, 2026). Entities under 50,000, and all special district governments, have until April 26, 2028 (was April 26, 2027). The rule took effect April 20, 2026; comments closed June 22, 2026. It does not change the WCAG 2.1 AA standard or the exceptions.

“Advanced technology, such as generative AI, does not yet reliably automate the remediation of inaccessible content at scale, and staff resources and availability continue to pose significant challenges.”

  4. DOJ says it will consider changes to the substance of the rule

In the same interim final rule, DOJ signaled possible future changes to what the rule requires:

“the Department plans to engage in future rulemaking processes related to the substantive requirements of the 2024 final rule. During the extension period, the Department will consider issuing an NPRM…”

As of October 7, 2026, no proposed rule has been published. Until one is, the 2024 rule and its WCAG 2.1 AA standard apply as written.

  5. Massachusetts Community Compact IT grants prioritize Title II accessibility

The state awarded $4 million to 67 municipalities ($5,000 to $140,000 each) in its FY26 Community Compact IT grant round. For the first time in the program's history, FY26 funding prioritized accessibility projects in compliance with the ADA Title II digital accessibility rule. Massachusetts towns planning document remediation should watch for the next cycle.
